Q: Hello, we are planning to purchase a home in Massachusetts, however the septic needs to be upgraded to Title V. This is a private rent with option to buy written contract in which the renter/buyer is responsible for upgrades to the home, so can the buyer install and pay for the septic prior to the purchase, eliminating the need for funds to be escrowed? Please advise. Thank you.

A: Sure, but make sure you have an iron-clad contract as if you chose not to purchase you may be out your money for the improvements

A: I would highly reccomend against the renter/buyer making any upgrades or improvements before obtaining actual ownership of the property.
What if after you installed the septic system the seller decided not to sell? There are way to many problems coupled with making improvements to property you do not own so I strongly suggest you wait it out.
